Subject: Clarification on crucial date of determination of age of 56 years for induction into AIS and its applicability with reference to the year of Select List-regarding.





The undersigned is directed to refer to the subject cited above and to say that on the directions of Hon’ble Supreme Court, and in consultation with Ministry of Home Affairs, Ministry of Environment and Forest, UPSC and the State Governments, the Central Government has decided to raise maximum age limit from 54 years to 56 years for promotion/induction from State Service/Non-State Civil Service to All India Service with effect from the Select List of 2015 with crucial date of determination of age as 01.01.2015. In order to implement this decision, this Department has issued four notifications dated 17.03.2015 amending the following regulations with the stipulation that these amendments will take effect from the date of their publication in the official gazette : -

The undersigned is directed to say that a revised Model Recruitment Rules (RRs) for the post of staff car driver has been issued vide this Department OM No. AB-14017/10/2014-Estt (RR) dated 4.7.2014. Accordingly Ministries / Departments have been advised to review the existing rules to bring them in conformity with the model RRs. It may be observed from column 10 of the model RRs that the method of recruitment prescribed for filling up the post of staff car driver (ordinary grade) is “Deputation/absorption failing which by direct recruitment”. Subject: Clarifications in the wake of Punjab & Haryana High Court order dated 1.2.2010 in CWP No. 15798 of 2009 filed by Shri Praveen Kumar Vs Union Public Service Commission and others as confirmed by Hon’ble Supreme Court in SLP No. 14002/2010 in the matter of DOPT Vs Praveen Kumar & others.





The undersigned is directed to refer to this Department’s OM No. 22012/99/2009-AIS-1 dated 25.8.2010 on the subject mentioned above and to say that in case of State Civil Services (SCS) officers if Select List is prepared for the vacancies of 2014 the same is required to be styled as select list of 2014 whereas for Non SCS the same is styled as 2015. Also in case of SCS, eligibility is required to be seen as on 1.1.2014 whereas in case of Non SCS the same is to be seen as on 1.1.2015. Thus, there is apparent anomaly in styling the Select List year for SCS officers and Non SCS officers prepared for the vacancies arising during the same year. This anomaly is due to the fact that as the Court order cited above was implemented for SCS officers only.

Department of Personnel and Training has now published the detailed minutes of the ‘Standing Committee of National Council JCM’ meeting held on 7.5.2014 on its portal. The meeting was chaired by Dr.S.K.Sarkar, Secretary DoPT and elevan members of JCM Staff Side was attended the meeting. 1. A meeting of the Standing Committee of the National Council (JCM), was held on 7.5.2014 at 11.00 AM in Conference Room No 119, North Block and was chaired by Dr S K Sarkar, Secretary DOP&T. A list of members who attended this meeting is at ANNEXURE I.

Submission of declaration of assets and liabilities by the public servants for each year – Dopt orders Feb 2015

Subject: Central Civil Services (Conduct) Rules, 1964 and The Lokpal and Lokayuktas Act, 2013 — Submission of declaration of assets and liabilities by the public servants for each year — regarding





The undersigned is directed to refer to this Department’ OM of even no. dated /16.01.2015 clarifying the provisions relating to submission of declaration of assets and liabilities by the public servants. As per this clarification, all Government Servants have been advised that:





(i) The annual Immovable Property Return (IPR), as on 31.12.2014, under the existing CCS(Conduct) Rules, 1964 is required to be filed on or before 31.01.2015;





(ii) The first return under the Lokpal and Lokayuktas Act, 2013 (as on 01.08.2014) should be filed on or before 30.04.2015; and





(iii) The next annual return under the Lokpal and Lokayuktas Act, 2013, for the year ending 31.03.2015, should be filed on or before 31.07.2015.





2. The Secretaries of all Ministries/ Departments have also been requested that all concerned may be suitably advised to file the IPRs and the return under the Lokpal Act as per the dates indicated above. A compliance report in respect of the IPRs filed by Group ‘A’ Officers of the Central Civil Services, as on 31.01.2015, has also been requested by 30.04.2015. It has also been requested that similar action may be taken by the authorities controlling services not covered by the Central Civil Services (Conduct) Rules, 1964.





3. In this regard it has been directed that all preparatory steps for the purpose of filing returns under the Lokpal and Lokayuktas Act, 2013, be put in place. An online system for filling the annual declarations of assets and liabilities by the public servants, as in PRISM (Property Related Information System) for IAS officers developed by NIC, may be adopted.





4. The Cadre Controlling Authorities are accordingly requested to please take immediate steps for putting in place all preparatory steps.
